Thank you for choosing PsyQ, a mood tracking app developed by Xergo Bogumił Styczeń (hereinafter referred to as: “we,” “us,” “our”). These comprehensive Terms of Use outline the conditions under which you may download, install, access, or use the PsyQ app. By engaging with the app, you agree to adhere to and be bound by these terms.

1. Acceptance of Terms:

1.1 Agreement: By downloading, installing, accessing, or using the PsyQ app, you explicitly acknowledge and agree to be bound by the terms and provisions outlined in this agreement. If you do not agree to these terms in their entirety, please refrain from using the app.

1.2 Modifications: We retain the right to modify, suspend, or discontinue any aspect of the app at any time, at our sole discretion, without prior notice. This includes adjustments to features, database, or content availability. Additionally, we may impose limitations on features and services or restrict your access to parts or all of the app without notice or liability.

2.1 Lawful Use: You agree to use the app strictly for lawful purposes and not for any activity that is unlawful or prohibited by these Terms of Use. Your use must conform to all applicable local, state, national, and international laws and regulations.

3. Intellectual Property:

3.1 Ownership: All intellectual property rights in the PsyQ app, including but not limited to patents, copyrights, trademarks, and trade secrets, belong to us or our licensors. The app is licensed, not sold, to you, and you have no rights other than the right to use it in accordance with these Terms of Use.

3.2 Restrictions: You explicitly agree not to copy, modify, create derivative works, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of the app.

4. Security Copies:

4.1 Local Backups: PsyQ provides you with the ability to create local backups of your logs on your device. This feature enables you to export log data to a file stored on your phone or other device. In the app settings, you’ll find an “Export” or “Backup” option facilitating the creation of a local backup. You can store this backup file securely, either on your device or in the cloud.

4.2 Cloud Backups: The PsyQ app also allows you to create cloud backups using services such as Google Drive or iCloud. The “Premium” version of the app lets you configure automatic cloud backups, ensuring regular synchronization of your data with the selected cloud service. This not only enhances security but also provides easy access to a backup copy in the event of device loss or damage.

Regardless of the backup method you choose, regular backups are essential. They ensure that your information is safeguarded, and you have the latest data saved in a secure location for potential restoration needs.

5. Subscriptions:

5.1 Free Version: The PsyQ app is available in three versions: free, monthly subscription, and annual subscription. The free version is accessible to all users without charge. However, it may have functional limitations, such as restricted access to core features, advertisements, or limited access to full content. This version is ideal for users seeking to familiarize themselves with basic functions and evaluate if the PsyQ application aligns with their expectations.

5.2 Monthly Subscription: The monthly subscription requires regular payments every month to unlock full access to all features and content. Subscribers may enjoy additional benefits such as an ad-free experience, access to exclusive content, or premium features. This option is suitable for users intending to use the PsyQ app continuously and desire full functionality throughout the subscription period.

The monthly subscription is paid in monthly installments, and renewal fees are automatically charged to your chosen payment method unless canceled. To avoid charges for the next month of your subscription, you must cancel it before the renewal date.

We do not provide refunds for the current subscription period. Your purchase will be governed by the payment policies of the respective platform. Please note that refunds may not be available.

5.3 Annual Subscription: Similar to the monthly subscription, the annual subscription requires a one-time payment for the entire year. Subscribers receive the same benefits as the monthly plan but at a potentially more cost-effective rate for those who plan to use the PsyQ app regularly over an extended period.

The annual subscription is a one-time payment for the full year, with automatic renewal unless canceled. To avoid charges for another year, you must cancel your subscription before the annual renewal.

We do not provide refunds for the current subscription period. Your purchase will be governed by the payment policies of the respective platform. Please note that refunds may not be available.

5.4 Trial Version: Before committing to a subscription, users have the opportunity to explore the trial version of the PsyQ app. This version allows users to experience all features and capabilities of the application for a specific trial period, typically ranging from a few days to a few weeks. The trial version enables users to assess whether the PsyQ app meets their expectations and whether subscribing is worthwhile.

For monthly subscriptions, the trial period is 1 week.
For annual subscriptions, the trial period is 1 week.

Please note that no refunds are provided, as sales are considered final. Users are encouraged to review and understand the terms and privacy policies of the respective app stores before making a subscription purchase.

6. Changes:

6.1 Modification of Terms: We reserve the right to modify the Terms of Use and Private Policy for its Website and app without prior notice. By using the website psyq.app or the PsyQ app, you agree to be bound by the current version of these Terms Use and Private Policy. It is important to periodically review the Terms of Use and Private Policy as any changes will be posted with the date of the last update. If there are significant changes, PsyQ will notify you through their website or in-app notifications.
